§ 1.6.7 Interests of Third Parties and the Public. The interests of third parties and the public are less often a factor than the other criteria previously discussed. Determining whether an injunction is in the public interest addresses the impact on non-parties rather than parties. United Food & Commercial Workers Local 99 v. Brewer, 817 F. Supp. 2d 1118, 1127 (D. Ariz. 2011) . However, when the public interest is involved, it will normally be determinative of the application. Winter v. NRDC , Inc., 555 U.S. 7, 24 (2008). As held by the Supreme Court in Yakus v. United States, 321 U.S. 414, 64 S. Ct. 660 (1944) :
