§ 3.3.1.12.2.11 Denial of Motion to Dismiss; Voluntary Dismissal. An order denying a motion to dismiss is an interlocutory, nonappealable order. See Davis v. Davis, 230 Ariz. 333, 335, ¶ 11, 284 P.3d 23, 25 (App. 2012); Qwest Corp. v. Kelly (McMahon), 204 Ariz. 25, 27, ¶ 3, 59 P.3d 789, 791 (App. 2002). However, denial of dismissal in a postjudgment order in a sexually violent person proceeding is a “special order made after final judgment” and therefore appealable pursuant to A.R.S. § 12-2101(C). See In re Commitment of Flemming, 212 Ariz. 306, 306, ¶ 1, 131 P.3d 478, 478 (App. 2006).
