15.12 FILING A COMPLAINT OR SUIT
An employee who believes that his or her rights under the FMLA have been violated may file a complaint with the Secretary of Labor or may file a

private lawsuit in a court of appropriate jurisdiction. 420 Any private lawsuit must be filed within two years 421 after the last action that the employee contends was in violation of the FMLA or within three years if the violation was willful. 422
