In this motor vehicle negligence case, the plaintiff, a public health assistant at the Department of Health, asserted that the defendant bus driver struck the co-defendant garbage truck in an intersection with such force that it caused significant, permanent injury to the plaintiff bus passenger and necessitated the need for extensive future medical treatment. The defendant denied negligence and argued that she entered the intersection with the green light and that the driver of the dump truck violated the traffic light and caused the collision. On January 2, 2018, the plaintiff was a passenger on a New York City Transit bus owned and operated by the defendant city and being driven by the defendant bus driver, traveling northbound on Crescent Street approaching the intersection with Etna Street in Brooklyn. The co-defendant was operating a city garbage truck traveling westbound at the intersection. The plaintiff contended that the defendant bus driver negligently failed to stop at a red traffic light controlling her entry into the intersection; failed to yield the right-of-way; and failed to observe the road and other vehicles on the road. The defendant bus struck the co-defendant garbage truck in the intersection and the plaintiff was thrown to the floor of the bus. The Public Transportation Safety Board investigated the accident and found, on video evidence of the collision, that the defendant bus driver faced a yellow light for 3 seconds and a red light for 7 seconds before impact and that the co-defendant garbage truck driver faced a green light for 5 seconds before the impact.
