4.2 EARLY ENTRY AND POSSESSION
4.201 Entry for Purposes of Inspection by Condemnors Generally. After following the procedures specified in section 25.1-203 or 33.2-1011 of the Virginia Code, a condemnor may enter property it is considering acquiring for the purpose of making surveys, tests, appraisals, or examinations to determine the suitability of the property for the project. The sheriff is specifically authorized to enforce this right by removing anyone forcibly resisting entry. 3
4.202 Entry for Purposes of Inspection by Natural Gas Companies. After following the procedures specified in section 56-49.01 of the Virginia Code, a natural gas company as defined in 15 U.S.C. § 717a may make examinations, tests, hand auger borings, appraisals, and surveys for its

proposed line or works to satisfy regulatory requirements and for the selection of the most advantageous route or location for its facilities. 4
4.203 Early Possession by VDOT. VDOT has the right to enter the property being condemned to commence the project once it has filed a certificate of take. 5
4.204 Early Possession by Localities. When a locality is authorized to acquire property by eminent domain, it may take possession before completion of eminent domain proceedings for the specific public uses identified in section 15.2-1904.
