The public sector prompt payment laws provide that the following contract language is void and against public policy: a provision that makes the contract subject to the laws of another state or requires any litigation, arbitration or other ADR proceeding “arising from the contract” to be conducted in another state. Therefore, the prompt payment law provides that a forum selection clause requiring the matter to be adjudicated outside of Arizona and a choice of law clause providing that the law of another state governs the contract are both void and against public policy.[159] The forum selection clause for arbitration may be preempted by the Federal Arbitration Act.[160]
