When additional work is required that will increase the contract cost, do not proceed with work without first notifying the public entity of the condition and additional cost, preferably in writing. If the public entity does not issue a satisfactory change order, then a claim arises. Review the contract for any timing requirements and requirements for documenting and formally submitting claims. Irrespective of negotiations, ensure all contract requirements and deadlines are met unless a signed change order has been issued. Follow the claims process set forth in the contract or standard specifications, but also review and docket legal deadlines applicable to preserving your claim.
