9.3.4 Severance
The rules governing joinder are broad. Trial courts, however, are permitted to order severance if a showing is made that the defendant will be prejudiced by the joinder.52 In most jurisdictions, the court can grant severance at the motion of either party, or it can order severance on its own, sua sponte. Because of concerns regarding judicial efficiency, severance motions are not normally granted.53
