This case was originally calendared for trial at the October 23, 2023, Trial Session of the Court in New York, New York. By Order of the Court dated September 29, 2023, this case was continued, and jurisdiction was retained by this Division of the Court.

On March 27, 2024, Respondent filed with the Court a Status Report. Respondent informed the Court that the proceedings in a related case (Docket No. 806-23L) were stayed by Order of the Court dated October 2, 2023, pending the outcome of Farhy v. Commissioner^[1]. As the related case is unable to proceed, the parties have similarly been unable to resolve this case.

For cause, it is

ORDERED that forty-five (45) days after the Court of Appeals issues a decision in Farhy v. Commissioner, the parties shall file with the Court a further status report, informing the Court of the then-present status of this case.
