ORDER REQUIRING SUPPLEMENTAL BRIEFING ON DEFENDANT SHORELINE'S MOTION FOR PARTIAL SUMMARY JUDGMENT

On January 27, 2023, Defendant Shoreline Biosciences, Inc. (Shoreline) filed a motion for partial summary judgment. (Doc. No. 127.) In the motion, Shoreline argues that it is entitled to summary judgment on the issue of whether 28 U.S.C. § 1498 bars Plaintiffs from suing Shoreline under 35 U.S.C. § 271(g) based on the induced pluripotent stem cell (“iPSC”) line manufactured by Lonza Walkersville, Inc. (“Lonza”) and sold to Shoreline by the National Institute of Health (“NIH”). (Id. at 1, 6-11.) A hearing on Shoreline's motion for summary judgment is currently scheduled for Monday, February 27, 2023 at 1:30 p.m Plaintiffs' opposition to the motion for summary judgment is due by February 13, 2023, and Shoreline's reply is due by February 17, 2023.

Upon reviewing the record, the Court finds it appropriate to have the parties address an additional issue at the February 27, 2023 hearing on Shoreline's motion for summary judgment. See Fed.R.Civ.P. 56(f) (“After giving notice and a reasonable time to respond, the court may: (1) grant summary judgment for a nonmovant; (2) grant the motion on grounds not raised by a party; or (3) consider summary judgment on its own after identifying for the parties material facts that may not be genuinely in dispute.”). As part of its motion for partial summary judgment, Shoreline has presented evidence that the Lonza line of iPSCs was manufactured in Walkersville, Maryland. (See Doc. No. 127-3 Baghbaderani Decl. ¶¶ 5, 6, Ex. A at 11, 13, Ex. D at 92, 94.) The Court notes that district courts are split on the issue of whether 35 U.S.C. § 271(g) applies to domestically manufactured products.
