(a) Anoriginalsuitmaybeledatanytimeby:
(1) aparentofthechild;
(2) thechildthrougharepresentat iveauthorizedbythecour t;
(3) acustodianorpersonhavingtherightofvisitationwit horaccesstothechildappointed
byanorderofacourtofanotherst ateorcountry;
(4) aguardianofthepersonoroftheestateofthechi ld;
(5) agovernmentalentity;
(6) theDepartmentofFamilyandProte ctiveServices;
(7) alicensedchildplacingagency;
(8) amanalleginghimselftobethef atherofachildlinginac cordancewithChapt er160,
subjecttothelimitat ionsofthatchapter,butnototherwise;
(9) aperson,otherthanafosterparent,relative, or designated caregiver of a child place d
by the Department of Family and Protecti ve Services,who hashadexcl usive act ual
care,control,andpossessionofthechildforatleastsixmonthsendingnotmorethan90
daysprecedingthed ateofthelingofthepetition;
(10) a person designated as the managing conser vatori na revoked orun revokedaf davit
ofrelinquishmentu nderChapter161ortowhomconsenttoa doptionhasbeeng ivenin
writingunde rChapter162;
(11)a personwit hwhomthe childa ndthe child'sgua rdian,ma nagingc onservator,or parent
haveresided forat least six monthse nding notmore than 90 dayspre ceding thed ate
ofthe ling ofthe petition if thech ild'sgu ardian, managing conser vator,or parent is
deceasedatthetimeofthel ingofthepetition;
(11) apersonwhoisthefosterparent,relative, or designated caregiverofac hil dpla ced byt he
Departme ntofFamilyandProtect iveServicesi ntheperson'shomeforat least12months
endingnotmorethan90dayspr ecedingthedateofthel ingofthepetition, unless:
(A) the child has been retur ned to the parent under Section 263.403; or
(B) the child has been placed with a parent and the suit by the Depar tment of
Family and Protective Serv ices has been dismissed under Section 263. 401;
