Harris v. State
Alabama Supreme Court 1210179
Christopher P. Hoffman and Peter Raymond of Reed Smith, LLP, New York, New York, for appellant.
Steve Marshall, att'y gen., and Jon B. Hayden, asst. att'y gen., for appellee.
The appellant, Westley Devone Harris, appeals the circuit court's summary dismissal of his petition for postconviction relief filed pursuant to Rule 32, Ala. R. Crim. P., in which he attacked his capital-murder convictions and sentence of death.1
In June 2005, Harris was convicted of four counts of capital murder for murdering Mila Ruth Ball, John Ball, Joanne Ball, and Tony Ball during the course of a burglary and one count of capital murder for murdering six victims -- Mila Ruth Ball, Willie Haslip, Joanne Ball, Jerry Ball, Tony Ball, and John Ball -- pursuant to one scheme or course of conduct. The jury recommended, by a vote of 7 to 5, that Harris be sentenced to life imprisonment without the possibility of parole. The trial court overrode the jury's recommendation and sentenced Harris to death.2 This Court affirmed Harris's convictions and death sentence on direct appeal. Harris v. State, 2 So. 3d 880 (Ala. Crim. App. 2007). The Alabama Supreme Court denied certiorari review, and this Court issued a certificate of judgment on August 15, 2008. The United States Supreme Court subsequently denied certiorari review. Harris v. Alabama, 555 U.S. 1155, 129 S.Ct. 1039, 173 L.Ed.2d 472 (2009).
In our opinion affirming Harris's convictions and sentence, this Court set out the facts surrounding the six murders:
