Hill v. Gable
This matter is before the Court on preliminary review of Petitioner Teon D'mon Hill's Petition for Writ of Habeas Corpus, Filing No. 1, brought pursuant to 28 U.S.C § 2254 and filed on January 12, 2023. Petitioner set forth in his petition that he was convicted after a jury trial in the District Court of Douglas County, Nebraska of first degree murder and two counts of possession of a firearm by a prohibited person and was sentenced on April 28, 2016 to life and two terms of 15 to 20 years' imprisonment. Filing No. 1 at 1-2. Petitioner filed a direct appeal, and the Nebraska Supreme Court affirmed his convictions and sentences on January 19, 2018. Id. at 2; see also State v. Hill, 905 N.W.2d 668 (Neb. 2018).
Petitioner filed a motion for new trial based on newly discovered evidence on January 16, 2019, which the state district court denied on May 14, 2020. Filing No. 1 at 3, 6, 17. Petitioner appealed the denial of the motion for new trial, and the Nebraska Supreme Court affirmed the state district court's decision on February 26, 2021. Id. at 17-18; State v. Hill, 955 N.W.2d 303 (Neb. 2021). Petitioner alleges he filed a motion for postconviction relief on April 1, 2021, within the “21 days left on [his] statute of limitations for filing an application for postconviction relief.” Filing No. 1 at 18. The state district court dismissed Petitioner's postconviction motion “because the statute of limitations had run,” and the Nebraska Supreme Court affirmed the dismissal on December 23, 2021. Id. at 18, 25; State v. Hill, 968 N.W.2d 96 (Neb. 2021).
It appears from the face of the petition that Petitioner's claims may be barred by the statute of limitations because the petition was filed more than one year after Petitioner's judgment became final. See 28 U.S.C. § 2244(d)(1). However, in order to ensure a just and fair resolution of this matter, the Court will enter an order progressing this case to final resolution. Respondent should be mindful of, and if necessary respond to Petitioner's assertion that the untimeliness of his petition is due to the advice of his postconviction counsel. See Filing No. 1 at 25.
IT IS THEREFORE ORDERED that:
1. By June 26, 2023, Respondent must file a motion for summary judgment or state court records in support of an answer. The Clerk of the Court is directed to set a pro se case management deadline in this case using the following text: June 26, 2023: deadline for Respondent to file state court records in support of answer or motion for summary judgment.
