The following order is recommended: In light of the decisions in Davis v. Washington (2006) ___ U.S. ___, 126 S.Ct. 2266, 165 L.Ed.2d 224 and People v. Cage (2007) 40 Cal.4th 965, 56 Cal.Rptr.3d 789, 155 P.3d 205, review in the above-entitled matter is dismissed. (Cal. Rules of Court, rule 8.528(b)(1).) Appellant's "Motion to Dismiss Review or Transfer Cause to Court of Appeal" is denied as moot. Cause remanded.
