The Director of the Office of Lawyers Professional Responsibility has filed a petition for disciplinary action alleging that respondent Randall J. Fuller has committed professional misconduct warranting public discipline, namely, failing to diligently pursue a client’s matter resulting in the loss of the client’s appeal rights, making knowingly false statements to a tribunal on four separate occasions, making knowingly false statements to respondent’s clients and partners regarding the status of the matter, and offering a falsely backdated brief as an exhibit to a tribunal. See Minn. R. Prof. Conduct 1.3, 3.3(a)(1), 3.3(a)(3), 4.1, 8.4(c), and 8.4(d).

Respondent and the Director have entered into a stipulation for discipline. In it, respondent withdraws his previously filed answer, unconditionally admits the allegations of the petition, and waives his procedural rights under Rule 14, Rules on Lawyers Professional Responsibility (RLPR). The parties jointly recommend that the appropriate discipline is an indefinite suspension with no right to petition for reinstatement for 5 months.

The court has independently reviewed the file and approves the recommended discipline.
