A. Scope of the Statute and Elements of a Cause of Action
Nevada law prohibits “deceptive trade practices”1 and “deceptive
advertising.”2 There is a detailed statutory framework that has become
more elaborate with passing decades, with numerous amendments to the
law adopted in 2021. However, there is relatively little interpretive case
law, due in part to the absence of an intermediate appellate court in the
state until 2015.
1. Deceptive Trade Practices
Chapter 598 of the Nevada Revised Statutes defines a variety of
“deceptive trade practices.”3 It specifically prohibits “pyramid
promotional schemes” and “endless chains,”4 deceptive charitable
solicitations,5 and deceptive sales promotions.6 Additionally, Chapter 598
includes specific provisions governing door-to-door sales,7 grant writing
services,8 credit service organizations,9 organizations for buying goods or
services at a discount,10 sightseeing tour brokers and operators,11 dance
