Form of Objection
· Defendant objects to the hearing being held by interactive video.
· Plaintiff objects to the hearing being held by interactive video because the court will be required to make credibility findings.
General Rule
· Before the Supreme Court of Missouri issued orders in response to the pandemic, the Missouri legislature addressed appearances by interactive video. See § 561.031, RSMo 2016. Also, § 546.550, RSMo 2016, requires “[f]or purpose of judgment, if the conviction be for an offense punishable by imprisonment . . . the defendant must be personally present.”
