Shaw v. Osborne (In re Osborne)
Plaintiff Khalliah Monique Shaw ("Plaintiff" or "Ms. Shaw") commenced this adversary proceeding for a determination that an unliquidated debt arising from a medical malpractice claim owed by the Defendant and Debtor Debra Ann Osborne (the "Debtor" or "Dr. Osborne") is not dischargeable under 11 U.S.C. § 523(a)(2)(A).1 The Court conducted a trial, heard the testimony of several witnesses, and received exhibits into evidence. After trial, each party submitted proposed findings of factand conclusions of law. After due consideration of the foregoing, the Court concludes, for the reasons that follow, that the debt is not excepted from discharge under 11 U.S.C. § 523(a)(2)(A).
The Court has jurisdiction over this matter under 28 U.S.C. §§ 157 and 1334(b). This is a core proceeding under 28 U.S.C. § 157(b)(2)(A) and (I). Venue is proper under 28 U.S.C. § 1409.
